6th update, Chuck, Tues., May 20

Mitch called tonight and gave me an update on Chuck. He was planning on taking the day off and picking Chuck up on Wed. and try to go to the therapist that Chuck had started therapy with or at least get an appointment. A diagnosis is necessary prior to going to CAL PERS and working toward getting a possible medical disability and/or medical retirement. He said that Chuck had 18 years in the CDC and 7 years in the Air Force. Mitch said that Chuck's high-blood pressure pills appear to working.

Mitch paid for the doctor's visits and tests so far to the tune of $400. There may be a point at which he may qualify for Medi-Cal or Medicaid, but Mitch felt for the immediate future he had to get Chuck in to see the doctor.

He has also contacted the attorney in charge of the foreclosure process and found the amount to bring Chuck's past-due amount current is $7,400. At his point he owes an additional $2,700 in past-due property taxes. Carlene, Mitch's sister, paid the $400 to get his electricity turned on again and $65 to get the gas turned on again. Forrest, Mitch's brother, sent Mitch $3,000 to put towards the house foreclosure. Sandi and I sent Mitch the same amount. He is to call tonight (Wed.) on what he found out today.

Chuck does have some type of 401K, I believe, that Mitch will try to get released even though there will be penalties for early withdrawal and will help to pay for part of the past-due amounts.

So, as you can see, Mitch is making progress on Chuck's behalf.

Jim, unless things changed, 10 years was all needed to be "vested". C.C.P.O.A. should be contacted regarding his being "retired" early. They could send Chuck (or Mitch) in the proper direction. If Chuck was retaliated on for what he was helping with, there is a way to fight that with the union.

Jim, thanks for Mitch's address and news on Sandi's surgery. I will be anxious to hear how your surgery goes. Do you have a date for it yet?

Jim, as Chuck has no medical insurance and no job, he qualifies for Medi-Cal. He just has to fill out the papers to get it started. Beings as he has medical need now some dr. offices can help get the paperwork started. It should be able to cover him until he either gets a medical retirement which should pay for his future medical care, or medical disability which he would still need Medi-Cal. You have to keep after it tho. Sometimes a person falls thru the cracks. BJ applied for Medi-Cal and it took 1 year but that was because he "fell thru a crack". Usually it takes about a month or so to get unless you have pressing medical needs. It runs for 6 months then you have to re-apply again in the last month to keep continuing coverage.

As for his 401k he should be able to get all of it out. When our house burnt down that is where we had our money. We were able to get it all out because of the financial loss and the fact that it would cost $12,000 for cleanup. We sent pictures and the estimate for cleanup. Mitch might just need to submit papers from the foreclosure to be able to get those funds released or moved over to a 457 in Cal Pers so he can remove funds as needed. he has to talk to Cal Pers about that but for Ben all it took was a phone call to them this last time to have things changed. Did Mitch find out anything about home Owners disability?
